I represent that I am 18 years old or older, in good health, and capable of participating in rigorous fitness activities,  including running, extensive calisthenics and other activities that might be conducted in a rigorous "boot camp" fitness program. I desire to participate in the program of my own free will. I acknowledge that it is my responsibility to consult my personal physician to determine my fitness to participate in the program and, to the extent that I have any health concerns or limitations, I have discussed them with my personal physician who has approved my participation on the program.

I acknowledge that rigorous exercise can be dangerous and entails a number of risks including, but not limited to, the risks of heart attack, heat exhaustion, stroke, dehydration and bone, joint and soft tissue injuries.  I also acknowledge that the consequences of an injury can be severe, including permanent disability or death, and severe social and economic loss.  Further, I acknowledge that injury might result not only from my own actions or inactions,  but also from the actions or inactions, including negligence and recklessness, of others, or the condition of the premises or of any equipment used.  I further acknowledge that the premises where the program takes place generally are not owned or controlled by The American Boot Camp Company ("TABCC") or any of its franchisees or licensees and may contain both visible and other hazards, including, but not limited to, uneven surfaces, holes, broken pavement, broken or inadequate equipment, exposed roots, speed bumps, inclement weather, and automobile traffic. Further, I acknowledge that there may be other unknown risks not reasonably foreseeable at this time.

In consideration of participation in the program, I assume the risk of participating in the program and accept personal responsibility for the damages following such injury, disability or death.

In further consideration of participation in the program, I do for myself, my heirs, executors, administrators and / or assigns hereby release, waive, discharge and relinquish any claim, action or cause of action that may hereafter arise for me or my estate arising from my participation in the program and agree that under no circumstance will I or my heirs, executors, administrators and / or assigns prosecute or present any claim for personal injury, property damage, loss of consortium, wrongful death or otherwise against TABCC, its franchisees, the counties of Cobb, DeKalb, Fulton or Gwinnett, the City of Atlanta and City of Brookhaven, their instructors, managers, employees, members and associated personnel, officers, directors or agents, including the owners, lessors and lessees of premises used in the program.

The American Boot Camp Company agrees to provide workouts and other services as described in the boot camp materials provide at orientation and on its website, and the participant agrees to pay in full the amount of all participation fees.  All sales are final, and payments are non-refundable. Failure to attend workouts does not entitle a participant to cancel payment or receive a refund.  TABCC administrators may make modifications in the workout schedule as deemed necessary. Such modifications do not relieve the participant of his or her payment obligations under any circumstances.

TABCC administrators and those acting under its authority reserve the right to use photographs, videotapes, artwork or other likenesses of the member for marketing, publishing or any other lawful purpose. Participant understands and agrees that emails related to boot camp and other related topics will be sent to the email address provided.

Missing Class/Absences
Our programs are based on accountability. In the case of excused absences, you will be permitted to make up 3 missed classes per session, unless otherwise agreed upon with the lead instructor. Credits for classes must be scheduled and used within a two weeks of the end of the session, except for documented medical reasons. No exceptions.
